Paris, France; February 02, 2023: France base human rights organization, JusticeMakers Bangladesh in France (JMBF) is gravely concerned and outraged over the tragic death of Faruk Hossain Hossain, a bodybuilder and former Mister Bangladesh, as well as the personal bodyguard of the former chairman of City Bank Limited, Mohammad Shoaib, due to alleged torture by the police at Bangshal Police Station under Dhaka Metropolitan Police (DMP) following arrest for possession of cannabis.
JMBF urges the formation of a judicial inquiry committee, headed by a justice of the High Court Division of the Supreme Court of Bangladesh, to investigate this incident, ensuring the highest levels of integrity and transparency in the proceedings. JMBF also calls for exemplary punishment for the alleged culprits through a fair and transparent trial under the Prohibition of Torture and Death in Custody Law 2013.
According to reports published in various news media in Bangladesh, it is learned that Faruk Hossain Hossain left his home on Khawaja Dewan Singh Lane, Lalbagh, Dhaka, at around 9:30 pm on January 12. An hour later, he called his wife, Ima Akter Ima Akter Happy, and informed her that he was being detained and tortured by some policemen of Kayetuli outpost under Bongshal Police Station in Dhaka. On hearing this news, Ima Akter Happy rushed there with their two-year-old child and saw that Faruk Hossain was beaten and detained by the policemen.
Ima Akter Happy requested Sub Inspector Imdadul Haque, Masood Rana, Bulbul Ahmed, and others who were present there to release her husband, holding their legs. Sub Inspector Imdadul Haque then told her that Faruk Hossain is a big criminal and abused them with filthy language. So, he can't be released freely, but if she wants to release him, a bribe of one lakh takas is required.
Ima Akter Happy mentioned that her husband is the personal bodyguard of the former chairman of City Bank, Mohammad Shoaib. Formerly a bodybuilder, he became Mister. Bangladesh. With three young children, Faruk Hossain lives on his income. Let him go. Later, the policemen reduced their demanded bribe from one lakh to 50 thousand. As she did not agree with their demand, they beat Faruk Hossain severely, claiming that Faruk Hossain is a drug dealer and they can't do anything without their senior officer's consent. After some time, Faruk Hossain was taken to Bangshal Police Station on a motorcycle.
Later, Ima Akter Happy dragged the hands and feet OC Mainul and begged for her husband’s release at the Bangshal Police Station but but it didn't work. Rather, he asked her to contact CMM court the next day. The next day, Ima Akter Happy went to court to inquire about her husband. She met her husband, where Faruk Hossain told her about the beating. He asked her to seek justice in court if something happened to him. That time, Ima Akter Happy came to know that a case of 150 grams of cannabis has been filed against Faruk Hossain. He returned home around 5-6 pm that day.
Later, at around 8:30 am on January 15, a person from Dhaka Medical College Hospital told Ima Akter Happy that Faruk Hossain had died. She went to the hospital morgue and found her husband's body. She found injury marks on his neck, chest, and back.
Later on January 30, 2024, Ima Akter Ima Akter Happy, the wife of victim Faruk Hossain Hossain, filed a case with the Metropolitan Session Court, Dhaka, against five police officers of Bangshal Police Station, and the learned court ordered the Detective Branch of Police (DB) to submit the report after investigating the incident by March 28, 2024.
Advocate Shahanur Islam, human rights lawyer, and the founder president of JusticeMakers Bangladesh in France (JMBF) urges the concerned authorities to address the allegations of police torture and misconduct and investigate the circumstances surrounding Faruk Hossain’s death promptly, as well as bring those responsible before the book.
JMBF thinks that Faruk Hossain's death is not an isolated occurrence but rather emblematic of a larger issue of human rights violations and a lack of accountability within Bangladesh's criminal justice system. JMBF also states that although Article 35(5) of the Constitution of the People's Republic of Bangladesh clearly prohibits all forms of torture, the police continue to employ torture for interrogation in their custody, without respecting the constitutional provision. This has resulted in the frequent deaths of citizens of Bangladesh.
JMBF urges the authorities to conduct an independent autopsy on Faruk Hossain's body to ascertain the cause of death with the utmost transparency and professionalism. JusticeMakers Bangladesh in France (JMBF) stands in solidarity with the family of Faruk Hossain Hossain and the community affected by this incident, and it will closely monitor the developments in this case.
